Office of the Prosecutor,
OFFICIAL COMMUNICATION ON THE MURDER OF J.B DANQUAH ADU(FORMER MEMBER OF PARLIAMENT OF THE REPUBLIC OF GHANA)*
The Alliance for Social Equity and Public Accountability-ASEPA is a Public Accountability and Human Rights Civil Society Organisation based in Accra, Ghana.
We write to your office pursuant to Article 15 of the Rome Statutes to initiate criminal investigations and possible prosecution against the President of the Republic of Ghana, Nana Addo Danquah Akufo Addo and the Member of Parliament for Assin Central in Ghana Mr. Kennedy Agyapong on the murder of Mr.Joseph Boakye Danquah Adu, former Member of Parliament for Abuakwa North in the Eastern Region of Ghana.
On the 9th of February, 2016 as Ghana geared into the 2016 General Elections, we woke up to the news of the gruesome murder of Hon.J.B Danquah-Adu, who was stabbed to death by an assailant.
Subsequently the assailant was arrested and identified as Daniel Asiedu( who is also referred to as Sexy Dondon by his peers).
Daniel Asiedu, young man in his early twenties, had no prior connection with Mr. J.B Danquah-Adu, admitted to the murder with the explanation that he went there for a robbery operation which ended up in the stabbing of the late Member of Parliament to death.
However Police preliminary investigations did not reveal any stolen items except for the mobile handset of the M.P which was retrieved from Mr.Asiedu after he was arrested.
Suffice to say that there were large sums of money in the bedroom of J.B Danquah-Adu which was left untouched by the assailant.
Right from the preliminary investigations, it became clear that, the murder of the former Member of Parliament, was a “contract killing”.
The case is currently being tried in the Court of Ghana.
Recently the key suspect in the trial Mr. Daniel Asiedu who had since day one admitted to the murder, made a stunning confession in Court that he was contracted by key Members of the New Patriotic Party,(the Political Party of the late J.B Danquah) to murder the late MP.
He subsequently mentioned some names including that of the Member of Parliament for Assin Central, Mr.Kennedy Agyapong as the main “contractor” who brought him the job.
Instead of further investigating his claim, he was rather referred to a psychiatrist for mental examination( in a woeful attempt by the Ghanaian Court to dismiss his confession)
The psychiatrist examinations has all come out negative, confirming that Mr. Asiedu is of sound mind and mentally stable but still his confession has not recieved the needed attention.
Over the weekend, Mr.Asiedu considering the attempt by the Court not to pay attention to his confession took to social media to give a full account of his crime( from incaceration) naming the people who contracted him to kill the late MP.
In the said video which has since gone viral and has been attached to this Communication and labelled as (Exhibit I),
Daniel Asiedu is heard, naming the Member of Parliament for Assin Central, Mr.Kennedy Agyapong as the main person who contracted him, gave him a picture of the target (who he did not know at the time) and even drove him to the house of the late MP to murder him.
He also mentioned one Allotey who he described as an informant for the Ghana Police Service who introduced him to Mr.Agyapong and the wife of Mr.JB Danquah-Adu who assisted him to get away after the crime.
Mr.Asiedu later admitted on the tape that during their first meeting, Mr.Agyapong revealed to him that the main person behind the “contract” was the then Flagbearer of the NPP and current President of the Republic of Ghana, Nana Addo Danquah Akuffo Addo who was then busy on the campaign trail and that he Mr.Agyapong was acting on his behalf.
Mr.Asiedu also said that he was promised by Mr.Agyapong that since it was very likely that Nana Akuffo Addo was going to win the 2016 elections, plans had been hatched to get him back his freedom immediately Nana Addo becomes President of Ghana.
Mr.Asiedu’s major motivation for speaking up points to the fact that the people who contracted him to commit the crime have neglected and abandoned him to his fate.
He also admitted on the tape that his life is in real danger and we have absolutely no reason to doubt him.
Considering the nature of his case and the status of the people he named as his contractors, we have notified the local office of the Amnesty International to provide human rights and other technical support for his safety and security in the prisons because we have probable cause to believe that his life is in real danger.
We are also petitioning your high office to open a Criminal investigations against the sitting President of the Republic of Ghana on the grounds of Political assassination and murder.
We also request an investigations against Mr.Kennedy Agyapong, Member of Parliament for Assin Central for Political murder, aiding abetting and an assessory to the murder of the late Joseph Boakye Danquah-Adu.
We hope that the ICC works locally with Amnesty International and the Diplomatic Missions like the U.S Embassy, the Canadian High Commission and other local missions and agencies who have all been copied in this Communication for a swift action to save the life of Mr.Daniel Asiedu, the main suspect in this case who would be a major witness for the prosecution at the ICC.
We are very confident, that irrespective of the COVID-19 outbreak that has affected several international organisations, the ICC would not relent on its core mandate to provide swift action and justice to the good people of Ghana on this matter.
Our doors are widely opened to assist in any capacity within our powers including provision of further information and other local assistance on the subject to augment the efforts of investigators.
Counting on your swift response and action.
